Attorney General Bailey filed a lawsuit against the administration, citing its failure to carry out an essential mandate passed by Congress.
“The Biden Administration has neglected its legal obligation to complete the construction of a border wall in the southwest,” Attorney General Bailey stated, underscoring the administration’s refusal to fulfill its constitutional responsibilities.
This legal triumph represents a critical moment in the ongoing push to strengthen our nation’s border amid urgent challenges.
The legal foundation for this action is rooted in a specific provision approved by Congress in FY 2020, which explicitly designated $1.4 billion for building barrier systems along the southern border.
Nevertheless, the Biden Administration openly disregarded this directive, voicing opposition to wall construction and expressing a clear intention to halt its expansion.
When confronted about the administration’s failure to execute the mandated barrier, a spokesperson affirmed that it “is not part of this administration’s policy,” reiterating its refusal to comply.
Moreover, the administration went as far as calling for the termination of remaining funding for the border wall, attempting to bypass Congress’ legislative authority.
Unfazed by the administration’s defiance, Missouri and Texas promptly initiated legal action.
The Biden Administration sought to dismiss General Bailey’s challenges on grounds of standing in contesting fund non-utilization.
However, the Fifth Circuit Court of Appeals ruled in favor of the states, affirming their right to bring a compelling legal challenge.
Missouri’s successful lawsuit against the Biden Administration represents a steadfast commitment to upholding congressional mandates and ensuring effective border security enforcement.
